General Terms and Conditions

1. These Sales and Usage Rules (hereinafter referred to as "Rules") define the mutual rights, obligations, delivery, exchange, and return conditions between an individual who orders goods from the online store www.packhub.de or personally via email, phone call, or during a meeting with a representative of PackHub, and PackHub.
2. Before using the online store www.packhub.de and generally making purchases from PackHub, you should thoroughly read and familiarize yourself with these Rules.
3. The buyer confirms that they have acquainted themselves with the Rules and agrees to adhere to them by checking the box labeled “I have familiarized myself with the Sales and Usage Rules and the personal data protection regulations and agree to them.”
4. If it is the seller's right or duty to send information or documents to the buyer via email, it is always the buyer’s responsibility to ensure that the email address provided to the seller is accessible and correct.
5. These Rules have been developed according to international, European, and Danish (German) law. Legal relationships arising from these Rules are subject to (German) law. Should disputes arise, an attempt will be made to resolve them through negotiations. If an agreement cannot be reached in this manner, the legal venue for all disputes arising from the business relationship between PackHub and the customer is the location of PackHub.

Offer and Contract Conclusion

1. All offers from PackHub are non-binding unless they are explicitly marked as binding or contain a specific acceptance deadline. The client may request offers from PackHub via the website www.packhub.de or via the hotline. 2. PackHub reserves ownership and copyright on all issued offers and estimates, as well as any drawings, illustrations, calculations, brochures, catalogs, models, tools, and other documents and aids provided to the client. The client may not make these items available to third parties without PackHub's explicit consent, disclose them, use them themselves or through third parties, or reproduce them. If requested by PackHub, these items and documents must be completely returned and any copies destroyed if they are no longer required by PackHub in the ordinary course of business or if negotiations do not lead to a contract.
3. In orders for delivery to third parties, the person placing the order is considered the client. If a delivery to third parties occurs or if the recipient otherwise enriches themselves by taking possession and further using the goods, both the person ordering the delivery and the recipient are regarded together as the client. By placing such an order, they hereby confirm their consent.
4. For customers who are merchants and conclude the contract in connection with their business activity or as self-employed persons, the right of withdrawal does not apply.

Delivery

●  Should the goods be shipped, the risk transfers to the client as soon as the shipment is handed over to the person conducting the transport.●  Goods are sent and delivered by PackHub through a delivery agent chosen by the buyer. (DHL/UPS/Nova Global)●  The handover of the goods is not part of the performance of delivering the goods to the address specified by the buyer, although the seller may also commission this service.●  We deliver free of charge to certain EU countries, excluding islands without a land connection. We can deliver to other countries, but the prices indicated in the webshop do not include shipping costs.●  The delivery times stated on the website cannot be regarded as guaranteed delivery times. These are estimated delivery times when we believe the goods will arrive at your location.●  In the event of a delivery delay, the buyer is entitled to withdraw from the contract only if the buyer has informed PackHub of the importance of the delivery deadline and a fixed delivery date is specified in the order confirmation.●  The buyer is entitled to withdraw from the contract if goods delivered by standard delivery are more than 30 days overdue. The buyer is entitled to withdraw from the contract if goods delivered by express are more than 5 days overdue.●  If the buyer wishes to contest the contract, they must notify PackHub of their complaint without delay.●  All deliveries are calculated only for delivery to the curb and do not include carrying up and down different floors.●  Special rates may sometimes be offered for delivery to a desired floor, but these must be specifically and separately requested.●  PackHub is not liable for the impossibility of delivery or for delivery delays, as far as these are caused by force majeure or other unforeseeable events at the time of contract conclusion (e.g., operational disruptions of any kind, difficulties in the procurement of materials or energy, transport delays, strikes) that are not attributable to PackHub. If such events significantly impede or make impossible the delivery or performance by PackHub and the hindrance is not only temporary, PackHub is entitled to withdraw from the contract.

Heading

1. The delivered goods must be immediately inspected upon receipt for their correctness. Shortfalls, incorrect deliveries, and defects must be reported in writing (via email/WhatsApp/Telegram/Viber/Instagram) within 3 working days (received by the contractor). In the case of legitimate and timely complaints, we are entitled to replace the goods or issue a credit. Hidden defects not found during the immediate inspection must be claimed within the legal warranty period.
2. In case of legitimate complaints, the contractor is obliged to rectify and/or replace the goods, excluding other claims, at its discretion. In the case of delayed, omitted, or failed rectification or replacement, the client may demand a reduction in payment (reduction) or rescission of the contract (conversion). Data must be provided in the file formats supplied by PackHub. Compliance with the data sheets is mandatory. We cannot guarantee flawless performance if different file formats are delivered unless we have agreed in writing to this format. The client fully assumes the accuracy of this data even in case of errors in data transmission or on the data carriers.

Producing of the Order, Approved by the Client

1. Data must be provided in the file formats supplied by PackHub. Compliance with the data sheets is mandatory. We cannot guarantee flawless performance if different file formats are delivered unless we have agreed in writing to this format. The client fully assumes the accuracy of this data even in case of errors in data transmission or on the data carriers.

2. There is no obligation to inspect deliveries from the client or a third party designated by the buyer - this also applies to data storage media and transmitted data. This does not apply in cases of obviously unusable or unreadable data or by written agreement. Data protection is solely the responsibility of the buyer. PackHub is entitled to make copies of the client data.

Defects

1. In case of material defects of the delivered item, PackHub is obligated and entitled to rectification or replacement delivery within a reasonable period. In the event of a defect, i.e., an impossible, unacceptable, refused, or unreasonable delay of the repair or replacement, the buyer may withdraw from the contract or demand a reduction of the purchase price.

2. If a defect is due to the fault of PackHub, the client may demand damages under the conditions agreed in the General Terms and Conditions.

Liability

1. The seller is only liable for damages caused by intentional or grossly negligent behavior, as well as for the violation of essential contractual obligations, to the extent that the achievement of the contract purpose is endangered, in the absence of guaranteed properties, and in cases of mandatory liability under the Product Liability Act. In the case of culpable violation of essential contractual obligations, liability is limited to foreseeable, contract-typical damages.

2. If claims for damages are made, they must be asserted in court within four months after the seller's written rejection.

Prices and Payment

1. Prices on the website are exclusive of value-added tax.
2. We reserve the right for price errors due to different currencies, higher authorities, tax changes, typographical errors, or system errors.
3. The buyer can pay the order by bank transfer, PayPal, or credit card. PackHub must have received the payment or proof of payment before production can begin.
4. Once PackHub has received payment for the goods and services and the design for the order has been completed and confirmed as suitable, production and delivery of the goods begin.
5. The buyer and the seller may agree on individual payment terms if the seller has given written consent.
6. If the payment deadline is exceeded and a reminder is issued, default interest at the rate of 8% above the respective base interest rate of the European Central Bank will be added to the invoice amount.

Assignment of Claims

1. The client may only offset their own claims with our claims if the counterclaim of the client is undisputed and has been legally established.
2. The assignment of the client's claim against PackHub is not permitted without prior written consent.

Marking

1. Buyers who purchase products from PackHub containing plastic must mark these with "PLASTIC IN THE PRODUCT" and a special label in accordance with Directive (EU) 2019/904. The seller is not liable for non-compliance with the marking regulations for such products.2. If the buyer purchases products from PackHub that are coated with a water-based varnish, the buyer must ensure that under the implementation of Directive (EU) 2019/904 into their national law, these products are not classified as products containing plastic and that the marking provided for in Directive (EU) 2019/904 does not apply to them. PackHub is not liable for non-compliance with the marking obligation for such products.

Return and Refund

●  The return and refund policy applies only to consumers.●  If you order products with your own imprint, we do not accept returns once they have been sent to production, as the products have been specially manufactured with your logo design.●  We accept the return of standard products without imprint and refund the full price. PackHub accepts returns of standard products only if they are returned within 14 days of delivery. The buyer bears the delivery and other costs for returning the products to PackHub.●  Any product you return must be in the same condition as when delivered and in the original packaging. Please keep the receipt.

Ownership

If the goods have not been fully paid for, PackHub retains ownership of the goods until they have been fully paid.
